Please read these Terms of Service carefully before using the Pūkeko Signals products, services, or dashboard. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By purchasing, installing, or using any Pūkeko Signals product or service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.

2. Description of Service

Pūkeko Signals provides solar-powered NB-IoT water pressure sensors and an associated dashboard for remote monitoring of water pressure on farms and rural properties in New Zealand. The service is intended as a monitoring and alerting tool to support, not replace, on-site management practices.

3. Indicative Nature of Pressure Readings

Pressure readings reported by Pūkeko Signals sensors are indicative only. They are not intended to represent a high level of metrological accuracy and must not be relied upon as a sole or definitive measurement of actual water pressure.

Users are responsible for ensuring that appropriate independent verification systems are in place to confirm the pressure being reported by the sensor against the actual pressure at the monitoring point. This may include periodic manual gauge readings or other means of verification.

A number of factors can cause readings to be inaccurate or unreliable, including but not limited to:

  • Weather conditions - extreme heat, cold, or atmospheric pressure changes can affect sensor output.
  • Water ingress - moisture or water entering the sensor housing can cause erroneous readings or sensor failure.
  • Extreme temperatures - temperatures outside the sensor's rated operating range may degrade accuracy or cause temporary failure.
  • Sensor drift - over time, sensors may drift from their original calibration.
  • Network or connectivity issues - delayed or missed transmissions may result in stale data being displayed.
  • Installation factors - incorrect installation, pipe vibration, air pockets, or incompatible fittings may affect readings.
  • Sampling intervals - sensors record readings at discrete intervals and may not capture pressure spikes or drops that occur between samples.

Pūkeko Signals accepts no liability for decisions made, or losses incurred, as a result of reliance on pressure readings that are inaccurate due to any of the above or any other cause.

4. Limitations of Liability

To the maximum extent permitted by law, Pūkeko Signals Ltd shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

  • Inaccurate, delayed, or missing sensor readings.
  • Service outages or interruptions to the dashboard or NB-IoT network.
  • Decisions made based on data provided by the service.
  • Loss of livestock, crops, revenue, or property resulting from water supply issues not detected or incorrectly reported by the system.
  • Alerts that are delayed, not delivered, or not triggered due to software or hardware issues, network failures, or any other cause.

Pūkeko Signals does not take responsibility for failures in water systems, including but not limited to pump failures, pipe bursts, valve failures, supply outages, or any other water infrastructure fault, regardless of whether the system was being monitored by a Pūkeko Signals sensor at the time.

Our liability is limited to the value of the hardware and subscription fees paid in the 12 months preceding any claim.

5. Alerts and Notifications

The alerting functionality provided by Pūkeko Signals is offered as a convenience feature and must not be relied upon as the sole means of monitoring water pressure or detecting system failures. Alerts may be delayed or may not be triggered at all due to factors including but not limited to:

  • Software defects or bugs in the sensor firmware, backend systems, or mobile application.
  • Hardware faults or sensor failures.
  • Network connectivity issues affecting data transmission from the sensor or delivery of push notifications and emails.
  • Threshold configuration errors made by the user.
  • Device or operating system settings blocking notifications on the recipient's phone or device.

Pūkeko Signals accepts no liability for any loss, damage, or consequence arising from an alert that was delayed, not delivered, or not triggered for any reason. Users should not rely solely on alerts as a substitute for regular on-site inspection and monitoring.

6. User Responsibilities

You agree to:

  • Install and maintain sensors in accordance with the provided installation guidelines.
  • Ensure sensors are protected from conditions beyond their rated specifications.
  • Regularly verify sensor readings against known reference measurements.
  • Keep your dashboard account credentials secure and not share them with unauthorised parties.
  • Notify us promptly of any suspected sensor malfunction or data anomaly.

7. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted access to the dashboard or continuous data transmission from sensors. Network coverage, server maintenance, and other factors outside our control may affect availability. We are not liable for any loss resulting from service downtime.

8. Intellectual Property

All software, firmware, branding, and content associated with Pūkeko Signals is the intellectual property of Pūkeko Signals Ltd. You may not reproduce, reverse-engineer, or redistribute any part of our products or services without written consent.

9. Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these terms by reference.

10. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the service after changes are published constitutes acceptance of the revised terms. We encourage you to review this page periodically.

11. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

13. Device Trials

Pūkeko Signals may offer device trials to eligible customers. Device trials are subject to the following terms:

  • Trial Duration: Where a trial period is offered, the trial shall be for the number of days stated at the time of offer. The trial period commences upon delivery of the device to the customer.
  • Device Limit: Each customer is limited to a maximum of 2 devices on trial at any given time.
  • Return and Refund: Devices may be returned during the trial period, and a full refund of all charges will be made upon receipt and inspection of the returned device.
  • Device Condition: Returned devices must be in working order or in a condition covered by the applicable subscription warranty. Devices showing signs of damage beyond normal wear, misuse, neglect, or failure to follow installation guidelines may not be eligible for refund or credit.
  • Return Deadline: Devices must be returned within the trial period to be eligible for refund. Devices returned outside the trial period will not be accepted for return or credit, except where applicable consumer protection laws require otherwise.

14. Subscription Trials

Pūkeko Signals may offer subscription trial periods to new customers. Subscription trials are distinct from device trials and are governed by the following terms:

  • Eligibility: Subscription trials are applied upon the first registration of a device to a customer account.
  • Trial Duration: The trial period begins upon registration of the first device and extends for the duration specified in the offer. Registering additional devices after the initial registration does not extend or reset the trial period.
  • Multiple Devices: Additional devices may be registered to the customer account during the subscription trial period and will be included in that trial, but they do not alter the trial duration or start date established by the first device registration.
  • Charges: Once the subscription trial period expires, standard subscription charges will apply to all registered devices on the account.
